How do I know if my flight is eligible for compensation?

Under the UK261 regulation (previously EU261), you can claim compensation if the flight cancellation was the airline’s responsibility, if your flight was cancelled less than 14 days before departure or if you arrived at your destination on a replacement flight by three hours or more. However, the amount you can claim for cancelled flights might depend on how long before the scheduled departure the airline informed you of the cancellation.

What is UK261?

UK261 regulations, established after Brexit, are the UK’s equivalent of EU261. It entitles consumers to compensation and refunds when flights are delayed or cancelled. Under UK261, passengers are entitled to compensation when their flight is delayed or cancelled and they arrive at their destination more than three hours later than scheduled. The amount of compensation available depends on the length of the flight.

What are extraordinary circumstances?

An airline can cite 'extraordinary circumstances' as a defence against a flight cancellation claim. And if these extraordinary circumstances apply, you may not be entitled to compensation. The main types of extraordinary circumstances include:

  • Extreme weather conditions

  • Strikes

  • Acts of terrorism or sabotage

  • Political or civil unrest

  • Hidden manufacturing defects

Your right to a refund or a rebooking

When flights are cancelled in the UK, passengers have the right to request a full refund or rebooking. Refunds can be granted for any portion of an unused ticket, including return and onward flights.
